The City of East Lansing has notified the HNHOA that effective immediately, they will not issue parking tickets in Phase 3. Phase 1 and 2 are still subject to ticketing by PACE as the City provides the service of maintaining and plowing our private roads. This responsibility was established in the First Amendment to the Master Deed of the Hawk Nest Condominium (Article IV, Section 3(a)(ii)) and reads “Upon completion of the private roads within the Project by the Developer, the City of East Lansing has contractually agreed to service and maintain the roads as set forth below…. The City’s obligation shall include routine maintenance, including filling potholes, sealing of cracks, sealcoat/skincoat, signage and striping, but shall not include the reconstruction or replacement of the road base, complete overlay or curb replacement, which shall be the responsibility of the Association.”
Since the streets in Phase 3 have not been completed by the Developer, the City does not have the maintenance responsibility for snow plowing. Any parking tickets in Phase 3 that have been issued to date may be eligible for a refund. The City is asking that anyone wishing to receive a refund complete the attached form and send it to the address listed. If you no longer have the ticket number or the exact date the ticket was issued, I suggest you submit a Freedom of Information Act (FOIA) request to the City Clerk with as much information as possible (narrowing down the date) and include the license plate number of the vehicle that received the ticket. They will then be able to research their information and provide the ticket number.
